Right of Withdrawal

In accordance with Art. of Legislative Decree No. 206 of September 6, 2005, as amended by Legislative Decree No. 21 of 21.02.14 (the "Consumer Code"), the Customer has the right to withdraw from the purchase contract for any reason, without having to provide explanations and without any penalty, within 14 days of receiving the purchased Product. 

Below are the instructions for exercising the right of withdrawal, as well as the consequences of such withdrawal.

To exercise this right, the Customer must send an explicit written notice within 14 working days from the date of receipt of the goods. This notice must be sent:

Once the above withdrawal notice has been received, DEEP BLUE SUB S.r.l. will promptly inform the Customer of the instructions for returning the goods. The consumer must return the Product(s) or deliver them to the seller or to a third party authorized by the seller to receive them, without undue delay and in any case within fourteen days from the date on which they informed the seller of their decision to withdraw from the contract.

The direct shipping costs for returning the Product are the responsibility of the Customer.

Items must be returned using one of the following options:

a) Via our courier using the guided procedure on our Returns Portal.

b) By physically returning the item or items to our premises in Varese.

c) By arranging shipment independently, exclusively by courier.

The purchased Product must be returned complete and intact, with all accessories and any spare parts, in the original packaging, complete in all its parts:

- properly packed in its original packaging, in perfect resale condition (not worn, damaged, or soiled) and complete with any accessories, instructions for use, and documentation;

- accompanied by the shipping document (included in the original packaging), so that DEEP BLUE SUB srl can identify the customer (Order number, first name, last name, and address);

- with no obvious signs of use.

If DEEP BLUE SUB S.r.l. receives returned items that are damaged or tampered with, it will not refund the amount paid for the purchase of the products.

DEEP BLUE SUB srl is not liable for any damage to the products occurring during shipment and return.

If the returned item does not comply with the requirements set out in the previous paragraph, the withdrawal will have no effect.

The buyer may not exercise the right of withdrawal for purchase contracts relating to products made to measure or clearly personalized, or products which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, as well as sterile items such as earplugs.

DEEP BLUE SUB S.r.l. will refund the price paid by the Consumer, provided that the item has been returned by the Consumer, within 30 (thirty) days from the date the goods are received at the Varese premises. The costs and risks associated with returning and transporting the returned item(s) are the responsibility of the customer.

Shipping costs due to an item exchange depend on the destination country and are always the responsibility of the customer.
